Dawn of Night respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established a process for responding to notices of alleged copyright infringement.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, please provide our Designated Copyright Agent with a written notice containing the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., URL, song ID).
• Your contact information: name, address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that your material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Please include:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the federal district court for the Northern District of Oklahoma if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notice.

What happens after we receive a valid counter-notification. We will promptly forward a copy to the person who submitted the original DMCA notice and inform them that we will restore the removed material in not less than ten (10) and not more than fourteen (14) business days. We will restore the material within that period unless we first receive notice from the original complainant that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat Infringers

Dawn of Night reserves the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

We have adopted and reasonably implement the following policy. We record valid copyright notices against the account that uploaded the material. An account that accumulates repeated valid notices, or that we determine is deliberately or blatantly infringing, will be terminated and may not open a new account. Notices withdrawn by the complainant, and notices successfully answered by a counter-notification, are not counted. Content removed under this process is not restored except through the counter-notification procedure above.

Limitation of Liability for User-Generated Content

As stated in our Terms of Service, users are solely responsible for the content they upload. Dawn of Night (and its owner) disclaims any liability for copyright infringement claims arising from user‑uploaded content. Upon receiving a valid DMCA notice, we will promptly remove the infringing material.
