You are solely responsible for any content you submit, upload, generate, or publish, including lyrics, descriptions, audio files, and images. You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any content you provide. You agree not to submit any copyrighted material that you do not have the right to use.

Each slot allows one song listed for sale at a time. Deleting a song or setting its price to $0 releases the slot. Unlimited plan grants unlimited listings for 30 days and does not consume slots. All purchases of sell slots and monthly plans are final and non‑refundable.
We offer an AI‑powered music generation tool powered by EvoLink.AI (EVO GLOBAL TECHNOLOGIES LIMITED). By using this feature, you agree to the following:

Dawn of Night is free to use. Browsing, streaming, the community, Becky’s Kitchen recipe tool and Auto-Cut video editing are available to every registered account at no cost and are not metered. Paid plans raise your monthly AI allowances; some AI features require a plan.
Every registered account has a Free Plan. No payment or card is required, ever. The Free Plan includes a monthly allowance of AI songs, images, chat and one short AI music video, plus unlimited Auto-Cut editing. Current Free Plan allowances are shown on the Plans page, which reads them from the same system that enforces them.
Founder and Admin accounts are not metered and are never required to subscribe.

🔴 These plans renew automatically every month until you cancel. A previous version of these Terms said plans were one-time charges; that is no longer correct and is corrected here. You are charged once per month at the price shown until you cancel.
The exact allowance for every feature on every plan is listed on the Plans page. Those figures are generated directly from the system that grants them, so what is advertised is what you receive.
Real motion video packs are a one-time purchase, not a subscription: 1 minute $14.99, 3 minutes $39.99, 6 minutes $69.99. Seconds are added to your account, do not expire, and are spent only when you render a motion video. They are separate from your plan and are not refunded once the footage has been generated. If a render fails for a technical reason, the seconds are returned to your balance.
Coins are a prepaid virtual credit with no cash value and are non-transferable. Coins spent on a completed generation are non-refundable; Coins charged for a generation that fails are returned automatically. Coins can also be exchanged for motion seconds at the same price as buying the pack outright.
In the Android app, purchases are handled by Google Play. Where Google offers it, the checkout screen also lets you choose PayPal instead, through Google Play’s User Choice Billing programme — you pick at the moment of purchase.
PayPal bonus: when you choose PayPal at checkout for a plan, we add 2 extra Fix an Old Photo and 1 extra Living Photo to your account, free, once per purchase.
On the website, plans are purchased through PayPal. Dawn of Night never sees or stores your card details.
Your account and everything you have created stay safe. You revert to the Free Plan and its allowances. Nothing you made is deleted because a plan lapsed. Renewing restores your allowances immediately.
The AI Music Video Maker turns a song you provide into a video using third-party AI providers (for example EvoLink). It offers AI picture scenes cut to the beat, and real filmed AI motion, which costs considerably more to produce and is limited by your plan or by a motion pack. The cost of a motion video is shown before you confirm it.
Your uploads & content: You are solely responsible for every song, image, and prompt you provide. You represent and warrant that you own or have all necessary rights and licenses to the material you upload and to create a video from it, that it does not infringe any copyright, trademark, right of publicity, privacy, or other right, and that it is not unlawful or otherwise prohibited under these Terms. You must read and agree to these Terms before making a video or uploading anything.
AI-generated media: AI output may be imperfect, may resemble other works, and is provided “as is.” You are responsible for how you use, publish, download, or distribute any video you create. Videos you Publish appear on Night Reels as your user content and remain subject to our copyright / DMCA process and content rules described elsewhere in these Terms; we may remove any content that violates these Terms.
Dawn of Night may revise these Terms, including revenue sharing percentages, AI service fees, and subscription prices, at any time. Changes are effective immediately upon posting. We will never apply increased fees retroactively to completed sales or already‑purchased credit packs / subscriptions. Your continued use after changes constitutes acceptance.
To the fullest extent permitted by law, Dawn of Night and its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from:
Our total aggregate liability shall not exceed the amount you paid to us, if any, in the preceding six months. The Service is provided “as is” and “as available” without warranties of any kind.
You agree to indemnify, defend, and hold harmless Dawn of Night, its owner, affiliates, officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of:

These Terms shall be governed by the laws of the State of Oklahoma, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Washington County, Oklahoma. (Note: EvoLink.AI’s separate terms are governed by Hong Kong law as stated in Section 5.)
